Denpasar, FLUNUD.ac.id -A member of the Bali Police, I Ketut Suartha successfully completed his studies at the Doctoral Study Program (S3) of Law Science FH UNUD through an Open Session for Doctoral Promotion on Wednesday (12/07/2023) at the FH UNUD Hall, Denpasar Campus with the title "LEGAL CERTAINTY OF THE REGULATION OF THE LIMIT OF TIME FOR ARRESTING CHILDREN CONFLICTING WITH THE LAW IN NARCOTICS CRIME BY POLRI OFFICERS."

The Open Session was chaired by the Dean of FH UNUD (Prof. Dr. Putu Gede Arya Sumerta Yasa, S.H., M.Hum), attended by the Promoter Team (Prof. Dr. I Made Subawa, S.H., M.S, Dr. Gde Made Swardhana, S.H., M.H, Dr. Ni Nengah Adiyaryani, S.H., M.H) and 4 other examining lecturers. There are 3 problem formulations discussed, namely: (1) What is the Philosophical Nature of the Time Limit for the Arrest of Children in Conflict with the Law in Narcotics Crimes by Police Investigators?; (2) How is the Arrangement of the Time Limit for the Arrest of Children in Conflict with the Law in Narcotics Crimes by Police Investigators in the Ius Constitutum Perspective?; (3) How is the Legal Certainty of the Arrangement of the Time Limit for the Arrest of Children in Conflict with the Law in Narcotics Crimes by Police Investigators in the Ius Constitituendum Perspective?.

The results of the dissertation show that there is a conflict of norms regarding the time limit for arresting children in narcotics crimes by Police Investigators to realize the 2nd Precept of Pancasila; conflict of norms between UURI No. 11/2012 Article 30 paragraph (1) with UURI No. 35/2009 Article 76 paragraph (1) and (2) which causes misalignment between the two laws and regulations which can result in the law cannot function as social control and legal uncertainty. The time limit for the arrest of children in conflict with the law in narcotics crimes should use UURI No. 35 of 2009 Article 76 paragraphs (1) and (2) so that there is legal certainty, fulfills a sense of justice and legal benefits for the community.
