Lawyer I Nengah Nuarta Successfully Obtained his Doctoral Degree in the Doctoral Program of Law Science FH UNUD

Denpasar, FLUNUD.ac.id - I Nengah Nuarta, a lawyer, successfully earned his doctorate through an open examination on Friday (10/03/2023) at the FH UNUD Hall, Denpasar Campus with the dissertation title "Policy Formulation of Electronic Trial Arrangements in the Indonesian Criminal Justice System."

The Open Examination was chaired by the Dean of FH UNUD (Prof. Dr. Putu Gede Arya Sumerta Yasa, S.H., M.Hum), attended by the Promoter Team: Prof. Dr. Ibrahim R., S.H., M.H., Dr. Gede Marhaendra Wija Atmaja, S.H., M.Hum, Dr. I Dewa Made Suartha, S.H., M.H. and 4 other examining lecturers. 

The 3 legal issues discussed in Dr. I Nengah Nuarta's dissertation are: The current regulation of electronic criminal trials has not provided legal certainty because it is still in the form of a Supreme Court Regulation (PERMA), the existence of conflicting norms regulated in PERMA No. 8 of 2002 concerning Amendments to Supreme Court Regulation No. 4 of 2020 concerning Administration and Trial of Criminal Cases in Court Electronically and the Criminal Procedure Code (KUHAP), the benefits of electronic trials during a pandemic to an endemic.

The results of the dissertation discussion show that the policy formulation of electronic trials in criminal justice in Indonesia can be regulated in the Draft Criminal Procedure Code. Judges determine electronic trials: related to the relevance of the application of electronic criminal trials in post-Covid-19 pandemic or endemic conditions with improvements in its regulation in the Draft Criminal Procedure Code in order to realize technology-based modern justice in Indonesia.
